RIA for the Act on the Services of Video Sharing Platforms (2018)

In 2018, EEIP prepared the Regulatory Impact Assessment (RIA) for the Ministry of Culture accompanying the proposal of changes needed to implement the Directive 2010/13/EU of the European Parliament and of the Council of 10 March 2010 on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the provision of audiovisual media services (Audiovisual Media Services Directive).

Until 2018, the Czech regulation of audiovisual media services was based on the European regulatory framework approved in March 2010. Nevertheless, the audiovisual media environment has been evolving very fast due to technological development and convergence between the television broadcasting and services distributed via the Internet can be observed. That is why the new directive was adopted after difficult negotiations with the European Parliament. It entered into force on December 2018, setting the deadline of 21 months to Member States for implementation.

The aim of the directive and therefore also of the proposed changes evaluated in the RIA was to set uniform conditions for players in the media market, increase protection of consumers and under-aged on the Internet, increase transparency and reduce administrative burden in response to the technological development, wider range of technological means for consuming audiovisual services, social and cultural changes, the fact that children increasingly decide independently what they will watch, etc.
