RIA for the proposal of transposition of the European Code of Electronic Communications (2019)

In 2019, EEIP prepared the Regulatory Impact Assessment (RIA) for the Ministry of Industry and Trade how to implement the Directive (EU) 2018/1972 of the European Parliament and of the Council of 11 December 2018 establishing the European Electronic Communications Code.

The European Electronic Communications Code revised and summarized four directives of the current regulatory framework (the framework directive, the authorization directive, the access directive and the universal service directive), merging them into a single regulation. The key reason for the change was the fact that since the last review of the regulatory framework for electronic communications in 2009 the sector had developed significantly.

The development brought about, among other things, new market players (such as over-the-top service providers), which newly compete with traditional telecommunications service providers and offer a wide range of applications and services. At the same time, also the demand for high-quality fixed or wireless connection increased and the number and popularity of internet content services​​, cloud computing, internet of things, machine-to-machine communication (M2M) has increased in general the field of electronic communications has strongly developed.

RIA thus addressed the most significant changes that were introduced by the Code, e.g. in the following areas:

  • management of radio spectrum in the single market,
  • ensuring uniform rules for all players, while strengthening consumer protection,
  • stimulating investment in high-speed networks,
  • universal service
  • institutional framework,
  • access to emergency communication services,
  • public warning system, etc.
