RIA for the new Building Act (2018 – 2020)
In 2018 – 2020, EEIP has prepared the Regulatory Impact Assessment evaluating impacts of the new Building Act.
The need of a fundamental change in public construction law was confirmed by the government on September 2018 after the approval of the material “Recodification of Public Construction Law, Information on the Main Directions and Objectives of Recodification, Ministry of Regional Development, August 2018” together with admission of a large number of problems in the area.
To prepare an effective, functional and simple regulation while maintaining the necessary level of protection of all rights and public interests, it was necessary to abandon the existing concept and prepare a completely new Building Act that would change the whole field, starting from the institutional setting, permitting processes etc. to changes in judicial review. Thus, the first step of the RIA process was the identification and classification of problems and then suggestion and quantification (where possible based on the data collected) of costs and benefits of the new regulation.
